Unenforceable Loan Agreements
Lenders are required to adhere to certain rules regarding the documentation for a credit agreement and in particular those £25,000 or under taken out before April 2007.
These loans were granted under the 1974 Consumer Credit Act which made certain requirements regarding the documentation mandatory.
Lenders have been found not to fully comply with the act and this renders the loan in certain circumstances unenforceable.
